Public Offer

1. General Provisions

This document constitutes an offer by Individual Entrepreneur Maksim Shelgunov (the “Contractor”) to enter into an agreement for access to the IISHKI online service (the “Service”). The User accepts this Offer by selecting the relevant checkbox and continuing registration, purchasing tokens, or using a paid feature of the Service.

The User confirms that they are at least 18 years old and have the legal capacity required to enter into this agreement. If the Service is used on behalf of an organization, the User confirms that they are authorized to act for that organization.

The Privacy Policy, AI Content Policy, and Refund Policy form an integral part of this agreement.

2. The Service

The Service provides an interface for creating images, videos, audio, text, and other materials using third-party AI models, as well as for storing and receiving results in the User’s account. Generations are processed asynchronously; processing time depends on the selected model and its provider.

Available models, features, limits, token prices, and processing times may change. Current parameters are displayed in the interface before a generation is started. The Service does not guarantee that any particular model or feature will remain permanently available.

3. Account and Security

• Users sign in through Telegram or Google and must not transfer account access to third parties.
• The User is responsible for account activity until the Contractor is notified of a compromise.
• The Contractor may restrict access in the event of a legal violation, a breach of the AI Content Policy, attempted payment circumvention, fraud, a chargeback, or a security threat.
• An erroneous restriction may be appealed by emailing support@iishki.com or messaging Telegram @maksim_and_ai_support.

4. Tokens and Deduction Order

A token is an internal unit used to measure access to Service features. It is not currency, electronic money, a security, or property; it cannot be transferred between Users or exchanged for money.

• The final token price is displayed before a generation is started.
• Subscription tokens are used first, followed by purchased tokens.
• Subscription tokens are set according to the applicable plan for each paid period; unused tokens do not carry over to the next period.
• Disabling automatic renewal does not terminate the period already paid for. Club terms and subscription tokens remain available until the displayed end date.
• Any remaining subscription tokens expire when the paid period ends.
• Purchased tokens remain valid for 90 days. A new purchase extends the validity of the entire unused purchased-token balance for another 90 days.
• If a technical failure by an AI provider is confirmed, tokens deducted for the failed generation are automatically restored to the balance.

The Service may apply different token prices to Users with an active Club subscription and to Users without one. The applicable price is displayed before each generation is started.

5. Price, Payment, and Subscription

The price and contents of a token package or plan are displayed immediately before payment. The seller and payment recipient is Individual Entrepreneur Maksim Shelgunov. The available payment method and its technical provider are identified during checkout. The Contractor does not receive or store full bank-card numbers, CVC/CVV codes, or other card credentials.

5.1. Token Purchases

A token package purchased on iishki.com is a one-time transaction. It does not activate a subscription, authorize recurring charges, or allow the Contractor to initiate later payments without a new action by the User.

5.2. IISHKI Club Subscription

Club membership is a recurring subscription with an automatic charge for each new billing period. During the first payment, the User separately authorizes storage of the payment method and recurring charges. The price, billing period, and cancellation method are displayed before confirmation.

The subscription and automatic renewal can be managed in the Telegram bot @iishki_club_bot. Once automatic renewal is disabled, the Contractor stops initiating new recurring payments but preserves access, the Club price, and subscription tokens through the end of the period already paid for. Before cancellation is confirmed, the bot displays the access end date and the effect on unused tokens.

Before confirming payment, the User sees the order contents, total price, currency, seller details, and charge terms. The technical payment partner is identified on its secure page.

6. User Content and Output

Rights to source materials remain with the User. The User grants the Contractor a limited right to store, technically transform, and transmit those materials to the selected AI providers solely to fulfill the request, maintain security, and provide support.

To the extent permitted by law and the terms of the relevant AI model, rights to the output belong to the User. The Contractor does not guarantee that an output is unique, does not resemble third-party material, is eligible for copyright registration, or is suitable for any specific commercial purpose. The User must review each output before publishing or using it in advertising.

A work is not made public automatically. Publication in the Inspiration section is possible only after a separate choice by the User and is governed by the Publication Consent.

7. Storage and Deletion of Materials

The User may delete generated works and is responsible for saving important results. Unless the User deletes them earlier, generated works are retained for at least 180 days from creation. After that minimum period, if the User's total token balance is zero, the Contractor may give notice and permanently delete the materials no earlier than seven days after that notice. Any replenishment of subscription or purchased tokens cancels the pending deletion countdown; a new full notice period starts only if the balance later returns to zero and the minimum retention condition remains satisfied. Purchased tokens normally remain valid for 90 days, and a new purchase extends the validity of the accumulated purchased-token balance. Uploaded source files are generally stored for up to 180 days, while links to materials from failed generations may be stored for up to 30 days. Further details are provided in the Privacy Policy.

8. Quality, Liability, and Force Majeure

AI output is probabilistic and may contain inaccuracies, artifacts, or unwanted elements. The Contractor takes reasonable technical measures to maintain the Service but is not responsible for disruptions involving communications networks, Telegram, payment systems, or independent AI providers outside its control.

Limitations of liability apply only to the extent permitted by mandatory law. Nothing in this Offer limits consumer rights that cannot be waived under the law of the consumer’s country of habitual residence.

9. Refunds and Claims

Refund terms are set out in the Refund Policy. A claim may be sent by email to support@iishki.com or through Telegram @maksim_and_ai_support; it should include the account, date, amount, payment method, and reason for the claim. A response will be provided within the period required by applicable law.

10. Amendment and Termination

A new version is published on this page together with its effective date and version-history entry. If terms change materially, the Service will show an in-app notice on the User’s next authenticated visit and request renewed acceptance before the User continues using the interface. The User may stop using the Service, disable automatic renewal through @iishki_club_bot, and request account deletion.

11. Governing Law and Dispute Resolution

This agreement is governed by the law of the Kyrgyz Republic unless mandatory provisions of the consumer’s country of residence require otherwise. The parties will first attempt to resolve a dispute through a written claim. This does not deprive the consumer of the right to apply to a competent court or public authority in a jurisdiction provided by mandatory law.
